European restructuring – towards a level playing field
Since the introduction of the European Union Insolvency Regulation in 2003, significant developments have occurred in European restructuring, mostly beneficial, that would have been unimaginable at the time. Although its objective was to facilitate cross-border insolvency process rather than disharmonies legislation, by the simple process that water finds its own level its existence has progressively led to a series of changes both in local legislation and in restructuring process which have been beneficial in preserving enterprise value in distressed European businesses.
